Privacy Policy
Effective date: June 19, 2026
Read this first. Broker Credibility is a platform where verified members of the transportation industry document and publish their own experiences with brokers, 3PLs, shippers, factoring companies, and other counterparties. Submissions, ratings, and comments are the statements of the members who post them. They are not the views, opinions, or statements of Broker Credibility. We operate as an interactive computer service and publisher of user-generated content within the meaning of 47 U.S.C. § 230 and do not adopt, endorse, or warrant any user submission. Submissions are intended to be public, indexed by search engines, and to remain part of the public record consistent with our editorial mission and the public interest in industry accountability.
1. Scope
This Privacy Policy ("Policy") describes how Broker Credibility ("Broker Credibility," "we," "us," or "our") collects, uses, shares, and protects information in connection with the Broker Credibility website, mobile experiences, member portals, AI Concierge, email communications, and related services (collectively, the "Platform").
This Policy is incorporated into, and governed by, the Broker Credibility Terms of Service and Content Submission Policy. Capitalized terms not defined here have the meaning given in the Terms of Service. To the extent the Terms of Service and this Policy address the same subject, this Policy controls for privacy matters. The limitation-of-liability, indemnification, arbitration, class-action waiver, and Commonwealth of Virginia governing-law provisions of the Terms of Service apply to this Policy and to any dispute arising out of it.
If you do not agree with this Policy, do not access or use the Platform.
2. Information we collect
We collect the following categories of information:
2.1 Information you provide directly.
- Account information: name, business name, role (carrier, dispatcher, broker, shipper, 3PL, factor, etc.), email address, phone number, MC number, DOT number, password (stored as a salted hash), and profile details.
- Verification information: government-issued identification, business registration documents, authority letters, FMCSA/SAFER lookups, selfie or liveness images, and the results of third-party identity and business-verification checks.
- Submission content: the experiences, ratings, comments, evidence, and other content you choose to upload — including bills of lading, rate confirmations, email threads, screenshots, audio recordings, and other documents. You are responsible for redacting third-party personal information from anything you upload.
- Payment information: processed by our payment provider (Stripe). We do not store full card numbers; we store the card brand, last four digits, expiration, billing ZIP, and a payment-method token.
- Communications: support tickets, dispute submissions, appeals, emails to us, and transcripts of conversations with the AI Concierge.
2.2 Information collected automatically.
- Device and usage data: IP address, device identifiers, browser type and version, operating system, language, referring URLs, pages viewed, time on page, click and scroll events, and timestamps.
- Cookies and similar technologies: see Section 7.
- Diagnostics: error logs, session replay (for bug diagnosis), and performance telemetry.
2.3 Information from third parties.
- Government and industry sources: FMCSA SAFER, federal and state public registries, insurance verification providers.
- Service providers: identity verification vendors, fraud-prevention vendors, payment processors, and email-deliverability providers.
- Other members: when another member tags a company or counterparty in a submission that may reference you or your business.
3. How we use information
We use information to:
- operate, maintain, and improve the Platform;
- verify your identity, role, and authority to post;
- moderate submissions, including AI screening and human review;
- prevent fraud, brigading, abuse, defamation risk, and unauthorized access;
- compute and publish credibility scores;
- respond to support requests and disputes;
- send transactional, security, and service messages;
- send marketing or newsletter messages, where permitted, with an opt-out in every message;
- comply with law, legal process, and our policies;
- establish, exercise, or defend legal claims; and
- protect the rights, property, and safety of Broker Credibility, our members, and the public.
4. Public submissions — please read this carefully
The Platform exists to make member experiences with industry counterparties part of the public record. By submitting Content you acknowledge and agree:
- Your submission is public. It is intended to be visible to other users, to the general public, and to search engines, and to be quoted, indexed, archived, and referenced.
- Your submission is your own statement. It reflects your personal opinion or your good-faith description of your own experience. It is not the view, opinion, statement, or endorsement of Broker Credibility.
- Section 230. Broker Credibility acts as a provider of an interactive computer service under 47 U.S.C. § 230. We are not the publisher or speaker of your submission, and we are not liable for it.
- Permanence. We may retain and continue to display your submission indefinitely, including after you close your account, where doing so is consistent with our editorial role, journalistic and public-interest purposes, the rights of other users to rely on the historical record, and applicable law. On request and where feasible, we may anonymize the submitting member's name on a published submission, but we are not obligated to remove the substance of the submission.
- Third-party information. You are responsible for redacting personal information about non-public individuals (e.g., a dispatcher's personal cell phone, a non-business email address) before uploading. We provide redaction guidance; we do not guarantee complete removal.
- Accuracy. You warrant that your submission is truthful, made in good faith, and based on your own first-hand experience or documentary evidence.
5. How we share information
We share information as follows:
- Service providers and subprocessors. Hosting and infrastructure providers; email and notification providers; payment processors (Stripe); analytics and error-monitoring providers; identity and business-verification vendors; AI model and inference providers (for the Concierge and for moderation); customer-support tooling. These providers process information only on our instructions.
- Other users and the public. Your published submissions, public profile fields, ratings, comments, and any evidence you mark public are visible to other users and to the public.
- Legal and safety disclosures. We may access, preserve, and disclose information when we believe in good faith that doing so is required by law, subpoena, court order, search warrant, or other legal process; necessary to enforce our Terms of Service or this Policy; necessary to investigate or prevent fraud, abuse, security incidents, or threats; or necessary to protect the rights, property, or personal safety of Broker Credibility, our members, or the public.
- Business transfers. If Broker Credibility is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of its assets, your information may be transferred as part of that transaction, subject to this Policy.
- With your consent. Any other sharing will be done with your direction or consent.
We do not sell personal information, and we do not "share" personal information for cross-context behavioral advertising, as those terms are defined under the California Consumer Privacy Act (CCPA/CPRA), the Virginia Consumer Data Protection Act (VCDPA), or similar state laws.
6. Subprocessor categories
We use vetted third parties to operate the Platform. Categories currently in use include: cloud hosting and serverless compute; database and storage; email delivery; SMS and notification delivery; payment processing; identity and document verification; FMCSA/SAFER lookup; analytics and product telemetry; error monitoring and session replay; large language model and AI inference providers; customer support tooling. 7. Cookies and similar technologies
We and our service providers use cookies, local storage, pixels, and similar technologies to:
- keep you signed in and remember preferences (essential / functional);
- measure how the Platform is used and to diagnose problems (analytics); and
- measure the performance of advertising and outreach campaigns (measurement).
You can control cookies through your browser. Disabling essential cookies will break sign-in and other core features. Where required by law, we honor the Global Privacy Control (GPC) signal as a valid opt-out of "sale" and "sharing." We do not currently respond to "Do Not Track" browser signals because no common industry standard exists for them.
8. AI features
The Platform includes AI features, including the AI Concierge, AI-assisted moderation, and AI-assisted writing tools. By using these features:
- your prompts, transcripts, and the relevant context may be sent to third-party AI model providers under contractual confidentiality and no-training terms with us;
- transcripts may be reviewed by our staff or automated systems for safety, abuse prevention, and quality assurance;
- AI outputs may be inaccurate, incomplete, or out of date — they are not legal, financial, safety, or compliance advice; and
- do not submit information through AI features that you do not want processed by a third-party model provider.
We do not sell your prompts or transcripts and we do not authorize providers to use them to train general-purpose models.
9. Security
We use technical and organizational measures designed to protect information, including TLS in transit, encryption at rest by our hosting provider, role-based access controls, multi-factor authentication for staff, secret rotation, and logging. No system is fully secure. We do not warrant that the Platform or any communication with it is free from interception, intrusion, loss, or unauthorized access beyond what is required by applicable law. You are responsible for safeguarding your account credentials.
10. Data retention
We retain information for as long as needed to operate the Platform and as described below:
- Account information — for the life of your account and for a reasonable period thereafter for security, audit, fraud-prevention, and legal-claims purposes.
- Verification documents — for the period required by applicable law and our compliance program, and then deleted or anonymized.
- Published submissions and ratings — may be retained indefinitely as part of the public record, consistent with Section 4.
- Payment records — as required by tax, accounting, and chargeback rules.
- Logs and telemetry — for a rolling diagnostic window, typically up to 24 months.
- Communications — for a reasonable period to support ongoing inquiries, disputes, and legal claims.
When we no longer need information, we delete, anonymize, or aggregate it.
11. Children
The Platform is intended for use by transportation-industry professionals and is not directed to individuals under 16. We do not knowingly collect personal information from children. If you believe a child has provided information to us, contact info@brokercredibility.com and we will take appropriate steps.
12. Your privacy rights
The rights below depend on where you live. To exercise any right, email info@brokercredibility.com with your request and enough information for us to verify your identity. We will respond within the timeframe required by applicable law. We do not discriminate against you for exercising a right.
12.1 California (CCPA / CPRA). California residents have the right to:
- know what categories and specific pieces of personal information we have collected, used, disclosed, sold, or shared in the prior 12 months;
- request deletion of personal information, subject to legal exceptions (including the public-interest, journalistic, and First Amendment exceptions that apply to published submissions);
- request correction of inaccurate personal information;
- opt out of the "sale" or "sharing" of personal information (we do not sell or share);
- limit the use of sensitive personal information;
- designate an authorized agent to submit requests on your behalf; and
- be free from retaliation for exercising your rights.
We do not offer financial incentives for personal information. "Shine the Light" requests for information about disclosures to third parties for direct marketing may be sent to info@brokercredibility.com.
12.2 Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), Oregon (OCPA), Montana, Delaware, New Hampshire, New Jersey, and other states with comprehensive privacy laws. Where applicable, you have the right to access, correct, delete, and obtain a portable copy of your personal data; to opt out of targeted advertising, the sale of personal data, and certain profiling; and to appeal a denial of your request. We do not engage in targeted advertising or sales as defined by these laws.
12.3 Nevada. Nevada residents may opt out of the sale of certain "covered information." We do not sell covered information.
12.4 EEA / UK. The Platform is operated from the United States and directed at U.S. industry users. If you contact us from the EEA or UK, you may have rights to access, rectify, erase, restrict, port, or object to processing of your personal data, and to lodge a complaint with your supervisory authority. The lawful bases on which we rely include contract performance, our legitimate interests in operating a public-interest accountability platform, compliance with law, and consent where required.
12.5 Submissions and the right to delete. The right to delete does not require us to remove published submissions where retention is permitted or required by law, is necessary to complete a transaction, is necessary to exercise free speech or comply with legal obligations, supports the public interest in industry accountability, or is otherwise within the editorial and journalistic exceptions provided by applicable privacy law and 47 U.S.C. § 230.
13. International data transfers
We operate the Platform from the United States. If you access the Platform from outside the United States, your information will be transferred to, stored in, and processed in the United States, where privacy laws may be different from those in your country.
14. Third-party links and services
The Platform may link to third-party websites, services, or advertisements. We are not responsible for their privacy practices. Review the privacy policies of any third party before providing them with information.
15. Changes to this Policy
We may update this Policy from time to time. When we make material changes, we will revise the "Effective date" above and notify you by email, by in-product notice, or by a banner on the Platform. Your continued use of the Platform after a change takes effect constitutes your acceptance of the updated Policy.
